Deferred Disposition

 

What is Deferred Disposition?
If the defendant would like to keep a citation off their record, deferred disposition may be requested. Deferred Disposition is a 90-day probation period. If all probation terms are met within the probation period, the ticket can be dismissed.  Requesting deferred disposition does not relieve you of paying the citation.

Requesting Deferred Disposition
Defendants can request deferred disposition by written request. In the request, please include your name, the citation number, your current mailing address, a current phone number, and your plea. The written request, all required documents, and payment (via money order), must be mailed to the court.

If the offense is a traffic offense classified as a moving violation and the defendant is younger than 25 years of age, then the judge shall require as a condition of deferred disposition that the defendant complete a driver safety course.  Items to send to the Court for a Deferred Disposition request:
  • Photocopy of your current auto liability policy
  • Photocopy of your valid Texas Drivers License
  • Copy of your citation
  • Money Order or Cashier's Check: (contact court for amount) - Made payable to East Bernard Municipal Court
  • Self-Addressed Stamped Envelope
  • Written Request and Plea
